These terms are the agreement between you and Smart Man Media, LLC ("we", "us") for using Notes to Play ("the app"): a songwriting app with a Play Studio for writing and playing your songs and a Mix & Master studio for mixing them and exporting the finished mix. The app is in a private beta: it is still being built, and you are trying it before it is finished. By signing in or using the app you agree to these terms.
1. The beta
- Access is by invitation, with a beta password. Please don't share the link or the password; we may change or withdraw them at any time.
- Features can change, break or disappear between versions. New versions install themselves when you open the app.
- The app is free during the beta. If it becomes a paid product later, we will tell you before anything is charged, and nothing will be charged without you agreeing.
2. Your songs are yours
- Everything you write, record or mix in the app, chords, melodies, lyrics, notes, recordings, song files, your mix settings and the WAV or MP3 mixes you export ("your content"), belongs to you. We claim no ownership of it.
- Your content is kept on your own device (see the Privacy Policy). We can't see it unless you choose to send it to us.
- If you send us a song with Send feedback, you let us use that copy only to understand and fix the problem or idea you reported, and to improve the app. We won't publish it or share it outside the people working on the app, and we'll delete it if you ask.
- Chord progressions, scales and common musical ideas aren't owned by anyone. The app suggests chords and patterns; what you make from them is yours.
3. Keep your own copies
Songs live in your browser's storage on each device. Clearing your browser's site data, resetting or losing the device, or a browser problem can delete them, and we can't recover them. Use Export (or Share) to keep copies of songs that matter to you. Recorded audio is not included in song exports yet. In Mix & Master you can also export the finished mix as a WAV or MP3 audio file.
4. Using the app fairly
Please don't:
- try to get around the sign-in, attack, overload or break the app or the website it runs on;
- copy, extract, resell or redistribute the app, its code, its sounds or its artwork (see the Copyright page), including pulling the instrument samples out to use elsewhere;
- use the app to record or share anything you don't have the right to, or anything unlawful.
5. Feedback
Ideas and suggestions you send help shape the app. You're free to send them, and we're free to use them to improve the app without owing you anything for them. Your songs stay yours (section 2).
6. No warranty
The app is a beta and is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise it will be error-free, always available, or that your content can't be lost.
7. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for lost songs, recordings or data, arising from your use of the beta. Nothing in these terms limits liability that can't be limited by law.
8. Ending access
You can stop using the app at any time; uninstalling it or clearing its site data removes it and your songs from that device. We may end the beta or remove anyone's access, for example if these terms are broken.
9. Changes
We may update these terms as the app grows. The date at the top shows the latest version; if a change matters, we'll tell you in the app. Using the app after a change means you accept it.
10. Law
These terms are governed by the laws of the State of Florida, USA. Any dispute about them will be handled by the state or federal courts serving Hernando County, Florida, except where the law where you live gives you rights that can't be taken away (including the right to bring a claim in your local courts).
11. Contact
Use Send feedback in the app, or write to [email protected].
